Overview

Pneumapsyche respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our platform.

If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our Designated Agent with the information specified below.

Filing a DMCA Notice

To file a notice of claimed infringement, you must provide a written notification that includes:

  1. Physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has allegedly been infringed;
  2. Identification of the copyrighted work claimed to have been infringed, or if multiple works are covered by a single notification, a representative list;
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (such as the URL);
  4. Your contact information including address, telephone number, and email address;
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright.
Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.

Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with the following information:

  1. Your physical or electronic signature;
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled;
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we will forward it to the original complaining party. The removed material may be restored within 10-14 business days unless the copyright owner files a court action against you.

Repeat Infringers

In accordance with the DMCA and other applicable law, Pneumapsyche has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers.

We may also, at our sole discretion, limit access to our platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
